Safety Pod Academy – Terms and Conditions
Application and Entire Agreement
1. These Terms and Conditions apply to the purchase of and access to online training courses, digital content, assessments, certifications, and related services ("Courses") provided via the Safety Pod Academy online platform ("Academy") by Safety Pod International Ltd, a company registered in England and Wales under number 15733190, whose registered office is 6 Wallis Road, Skippers Lane Industrial Estate, Middlesbrough, TS6 6JB ("we", "us", or "our").
2. These Terms and Conditions will be deemed accepted by you ("you" or "Customer") when you:
- accept them during account registration or checkout;
- purchase or enrol on any Course; or
- access or use the Academy platform, whichever occurs first.
These Terms and Conditions constitute the entire agreement between you and us in relation to the Academy and replace any prior discussions, correspondence, or agreements.
3. These Terms and Conditions, together with any course description, order confirmation, or quotation (together, the "Contract"), apply to the exclusion of any other terms you seek to impose or which may be implied by trade, custom, practice, or course of dealing.
Interpretation
4. A "Business Day" means any day other than a Saturday, Sunday, or bank holiday in England and Wales.
5. Headings are for convenience only and do not affect interpretation.
6. Words in the singular include the plural and vice versa
Courses and Academy Access
7. The description and content of Courses are set out on the Academy website or within course materials and may be updated from time to time. Course descriptions are provided for guidance only.
8. By enrolling on a Course, you acknowledge that you have not relied on any statement, promise, or representation other than those expressly set out in the Contract.
9. We reserve the right to:
10. update, amend, or improve Course content to reflect changes in legislation, guidance, best practice, or evidence;
11. modify the structure, format, or delivery method of Courses;
12. restrict access to Courses where prerequisite qualifications, certifications, or verification steps are required.
Eligibility and Verification
13. Certain Courses are intended for instructors or professionals only. Access may be conditional upon:
- submission of valid qualifications or certifications;
- confirmation of professional role or experience; and/or
- agreement to specific professional standards, principles, or pledges.
14. We reserve the right to refuse, suspend, or revoke access where eligibility requirements are not met or where information provided is inaccurate or misleading.
Price and Payment
15. The price for Courses ("Price") is as stated on the Academy website or in a quotation at the time of purchase.
16. Unless otherwise stated:
- Prices are inclusive of applicable VAT and taxes.
- Any discounts or promotional pricing are offered at our discretion and may be withdrawn at any time.
17. Payment must be made in full at the time of purchase or in accordance with any agreed credit terms. Access to Courses may be suspended or withheld until payment is received.
18. All payments must be made in British Pounds unless otherwise agreed in writing.
Cancellation, Refunds, and Course Changes
19. Course availability, content, and pricing are subject to change without notice.
20. Unless otherwise stated in writing:
- Purchases of digital Courses and online content are non-refundable once access has been granted.
- You may cancel an order prior to accessing the Course.
21. We reserve the right to cancel or withdraw a Course at any time. Where this occurs, we will provide a suitable alternative or refund at our discretion.
Access, Use, and Platform Availability
22. Access to the Academy is granted on a non-exclusive, non-transferable basis for your personal or professional use only.
23. You must not:
- share login details or Course content with third parties;
- copy, record, distribute, or reproduce Course materials without our prior written consent;
- use the Academy or Courses for any unlawful or unauthorised purpose.
24. We do not guarantee uninterrupted access to the Academy and will not be liable for temporary unavailability due to maintenance, updates, or circumstances beyond our control.
Assessment, Certification, and Acceptance
25. Where Courses include assessments, practical submissions, or competency checks:
- you are responsible for submitting accurate and complete information;
- certification is awarded only upon successful completion in line with stated criteria;
- we reserve the right to withhold or revoke certification where standards are not met.
26. Completion of a Course does not guarantee competence, employment, or regulatory approval. Responsibility for applying learning appropriately remains with you and your organisation.
Intellectual Property
27. All Course materials, videos, documents, trademarks, logos, and content within the Academy are our intellectual property or licensed to us.
28. No rights are granted to you other than the right to access and use the Courses in accordance with these Terms and Conditions.
Termination and Suspension
29. We may suspend or terminate your access to the Academy immediately if:
- you breach these Terms and Conditions;
- you misuse the platform or content;
- you provide false or misleading information;
- your conduct risks harm, reputational damage, or non-compliance with professional standards.
30. Termination does not entitle you to a refund unless required by law.
Limitation of Liability
31. Our liability under the Contract, in tort, misrepresentation, or otherwise, is limited to this section.
32. To the fullest extent permitted by law:
33. our total liability shall not exceed the Price paid by you for the relevant Course;
34. we are not liable for indirect or consequential loss, loss of profits, loss of data, loss of reputation, or business interruption;
35. we are not responsible for how Course content is applied in practice or for decisions made based on Course materials.
36. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any matter that cannot be excluded by law.
Communications
37. All notices must be in writing and will be deemed received:
- when delivered by hand or courier during normal business hours;
- when sent by email with successful transmission;
- five Business Days after posting within the UK.
38. Notices should be sent to the most recent contact details provided.
Data Protection
39. In providing access to the Academy, we may process personal data in accordance with the UK GDPR and applicable data protection legislation.
40. You acknowledge that:
- you are the data subject or data controller of information you submit;
- we act as data processor where applicable;
41. personal data will be processed only for the purposes of delivering Courses and operating the Academy.

Circumstances Beyond Control
43. Neither party will be liable for failure or delay in performance caused by events beyond reasonable control, including but not limited to natural disasters, acts of government, system failures, or industrial action.
No Waiver
44. Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other.
Severance
45. If any provision is found to be unlawful or unenforceable, it will be severed without affecting the remaining provisions.
Law and Jurisdiction
46. These Terms and Conditions are governed by the law of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the English and Welsh courts.
